All parts are guaranteed to be as specified. All work to be completed in a workman like manner according to professional standards & practices. Any alteration or deviation from the above specifications involving extra costs or time will be executed only upon written orders and will be charged over & above the above estimate. Nothing in this agreement shall be construed to guarantee the loss of data due to a system crash, hard drive failure, software malfunction, or any malfunction beyond the technician’s control. It is the customer’s responsibility to have a current data backup, their data properly backed up, or to pay to have their data professionally backed up for them. In the unlikely event that it becomes necessary to enforce the terms of this agreement or a dispute concerning the terms of this agreement, Computer-Me-Tutor/Southwest Florida Tech Services shall be entitled to recover its reasonable cost, fees and expenses to include reasonable attorney fees, witness fees, consultant fees and other professional fees whether suit is brought or not and whether any settlement shall be entered into any action, trial or on appeal.

If the account remains unpaid 15 days after the due date, the buyer agrees to interest at the rate of 1.5% per month (18%) annually on the unpaid sums. If it becomes necessary to effect collection, the undersigned agrees to pay all costs of collection, including reasonable court costs and attorneys fees and, in the event litigation concerning this agreement, the parties agree that the sole venue of such action will be held in Lee County, Florida.
